About the Whistleblower Channel
This regulation defines the procedures and rules to be adopted regarding the communication, reception, follow-up, and archiving of reports of infringements committed within the company, or through the company Plasteuropa Embalagens, S.A.
The procedures align the practices of Plasteuropa Embalagens, S.A with the General Whistleblower Protection Regime, provided for by Law no. 93/2021 of December 20, ensuring effective protection for whistleblowers.
The internal reporting channel allows for the secure submission and follow-up of reports, ensuring their comprehensiveness, integrity, and preservation, the confidentiality of the whistleblower's identity or the whistleblower's anonymity, and the confidentiality of the identity of third parties mentioned in the report.
Plasteuropa Embalagens, S.A is a responsible organization that is governed by high ethical standards, understanding that reporting any infringements committed within or through the company is essential to its success and reputation.
Whistleblowers
The following are legitimate to use Plasteuropa Embalagens, S.A.'s internal reporting channel, as Whistleblowers:
- Workers;
- Service providers, contractors, subcontractors, suppliers and any persons acting under their supervision or direction;
- Shareholders and persons belonging to administrative or management bodies, or fiscal or supervisory bodies of legal entities, including non-executive members;
- Volunteers and interns.
Reportable Infringements
“Infringements” susceptible to being reported through the implemented reporting channel are considered all acts or omissions, contrary to law, related to the following areas:
- Public procurement;
- Financial services, products and markets and prevention of money laundering and terrorist financing;
- Product safety and compliance;
- Transport safety;
- Environmental protection;
- Radiation protection and nuclear safety;
- Food safety for human and animal consumption;
- Animal health and animal welfare;
- Public health;
- Consumer defense;
- Protection of privacy and personal data and security of network and information systems;
- Fraud and any other illegal activities detrimental to financial interests;
- Internal market rules, including competition rules and state aid, as well as corporate taxation rules;
- Cases of violent crime, especially violent and highly organized;
- Cases of organized and economic-financial crime (crimes of corruption, undue receipt of advantage, economic participation in business, embezzlement, influence peddling, money laundering).
Reports submitted through the reporting channel that exceed this scope are not covered by the protection provided for in the General Whistleblower Protection Regime, provided for by Law no. 93/2021 of December 20, nor do they follow the legally established procedures for the reception and follow-up of reports.
The Whistleblower may also use Plasteuropa Embalagens, S.A.'s internal reporting channel to report acts they become aware of, committed within the company, regarding infringements that exceed the scope of matters covered by protection (for example: harassment, discrimination, conflict of interest, persecution or violation of rules provided for in the Code of Conduct and which do not relate to the matters listed above).
In these cases, Plasteuropa Embalagens, S.A will also promote the appropriate follow-up of such reports, prohibiting retaliation against the whistleblower, provided that they have acted in good faith.
Reports submitted through the reporting channel may include infringements already committed, currently being committed, or whose commission can reasonably be foreseen, as well as attempts to conceal such infringements.
The reporting of an infringement may be based on information obtained in a professional relationship that has since ceased, as well as during the recruitment process or during another pre-contractual negotiation phase of a professional relationship, whether established or not.
How to Report an Infringement
The whistleblower may choose to make the report confidentially or anonymously.
If you choose to make a confidential report, the identity of the Reporter, any information that directly or indirectly identifies them, and the identity of any third parties mentioned in the report will be restricted to those responsible for handling reports. The identity may only be revealed in compliance with a legal obligation or court order. Registering your identity allows you to document the entire procedure and, consequently, to assert your rights to protection, as conferred by Law No. 93/2021 of 20 December, so we recommend that you use this option.
If you choose to make an anonymous report, your identity will not be revealed, so you should not provide any data or information that could directly or indirectly facilitate the recognition of your identity.
